Elite You Terms of Service

These Terms of Service (“Terms”) form a legally binding agreement between The Elite You LLC (“Elite You,” “Company,” “we,” “us,” or “our”) and any person who accesses or uses the Elite You website, Kajabi-hosted pages and member areas, the Elite You mobile applications for Apple iOS and Android, and any related content, digital products, memberships, forms, community features, downloads, communications, and services (collectively, the “Services”).

By accessing or using the Services, creating an account, downloading or using our mobile applications, purchasing a membership or digital product, submitting a form, or otherwise interacting with the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.

1. Nature of the Services

Elite You provides educational and informational content related to self-protection, situational awareness, decision-making, preparedness, fitness, training methodology, and related topics. The Services may include memberships, digital lessons, modules, courses, downloadable materials, applications for private training, community features, email communications, push notifications, and related content.

The Services are provided for educational and informational purposes only. Nothing in the Services constitutes legal, medical, mental health, firearms, security, tactical, or other professional advice specific to your individual circumstances.

2. Mature Content Warning

The Services may include mature, graphic, or disturbing educational content, including discussion or analysis of violence, criminal acts, self-defense, severe bodily injury, use of force, or death.

By using the Services, you acknowledge that:

the content is intended for mature audiences,
some material may be disturbing,
viewer and user discretion is advised,
and you are choosing to access this material voluntarily.

If you are not comfortable with such material, do not use the Services.

3. No Professional Advice; Educational Use Only

All content provided through the Services is for general educational and informational purposes only.

Elite You does not provide:

legal advice,
medical advice,
mental health advice,
individualized security advice,
licensed firearms instruction where such licensing is required,
or any other regulated professional service unless expressly stated in writing.

You are solely responsible for how you interpret and use any information provided through the Services. You should seek qualified local professional advice where appropriate.

4. Assumption of Risk

You acknowledge that topics discussed or demonstrated through the Services may involve physical training, self-defense concepts, use-of-force decision-making, weapons-related topics, or other inherently dangerous subject matter.

By using the Services, you understand and agree that:

physical training and defensive training involve risk,
applying concepts discussed in the Services may lead to injury, death, property damage, or legal consequences,
you assume full responsibility for your choices, actions, and results,
and you use the Services entirely at your own risk.

You should train within your abilities, follow all applicable safety rules, use qualified in-person supervision where appropriate, and comply with all laws that apply to you.

5. Eligibility and Age Requirements

You must be at least 18 years old to use the Services, create an account, purchase content, participate in community areas, or submit training applications.

By using the Services, you represent and warrant that:

you are at least 18 years old,
you have the legal capacity to enter into these Terms,
the information you provide is accurate,
and your use of the Services does not violate applicable law.

We reserve the right to request age verification or identity verification where reasonably necessary.

6. Accounts and Account Security

Some parts of the Services may require you to create an account. You are responsible for:

maintaining the confidentiality of your login credentials,
all activity that occurs under your account,
and notifying us promptly of any unauthorized access or suspected security issue.

We may suspend or terminate accounts that are false, misleading, shared improperly, abusive, or in violation of these Terms.

7. Memberships, Digital Products, and Payments

Elite You may offer memberships, digital products, subscriptions, coaching-related access, or other paid Services.

By purchasing, you agree that:

you are authorized to use the selected payment method,
you will pay all charges, taxes, and applicable fees,
and you have reviewed the offer details before purchasing.

Automatic Renewal

If you purchase a recurring subscription, you authorize us to charge your payment method automatically at the applicable renewal interval unless you cancel before renewal.

Pricing

We may change pricing, packaging, features, or availability at any time. Price changes will not retroactively affect completed purchases but may apply to future renewals or future purchases as permitted by law.

Cancellation

You may cancel recurring subscriptions before the next renewal date through your account settings or by following the cancellation method made available through the platform.

Unless otherwise stated, cancellation takes effect at the end of the current billing period.

8. Refund Policy

Unless expressly stated otherwise on a specific offer page, all sales are final and payments are non-refundable.

This includes, without limitation:

membership fees,
subscription fees already charged,
digital products,
downloadable materials,
and partially used billing periods.

If we choose to make an exception in a particular case, that does not obligate us to do so in future cases.

9. Private Training, Hosted Training, and Applications

Elite You may allow users to submit inquiries or applications for private coaching, hosted training, consulting, or similar services.

Submitting an application or inquiry does not guarantee acceptance, scheduling, or availability.

Any private or hosted training arrangement is subject to:

review and approval,
separate scope confirmation,
pricing confirmation,
travel and logistics terms where applicable,
and any additional written agreement required by us.

We reserve the right to decline any request for any lawful reason.

10. Mobile Applications

The Services may be available through Elite You mobile applications for iOS and Android. Your use of those apps is also subject to these Terms.

You acknowledge and agree that:

app availability may depend on device compatibility, operating system version, internet access, and third-party platform availability,
certain features may not function on every device or OS version,
app functionality may change over time,
and you may need to install updates to continue using some or all app features.

We do not guarantee that the mobile apps will be compatible with all devices, operating systems, carriers, or regions.

11. Push Notifications

If you install or use our mobile applications, you may receive push notifications, alerts, reminders, or similar communications.

By enabling push notifications, you consent to receiving them. You may disable push notifications at any time through your device settings.

12. App Stores and Third-Party Platforms

The Services may be distributed or supported through third-party platforms and providers, including Kajabi, Apple, Google, payment processors, email tools, analytics providers, and hosting vendors.

You acknowledge and agree that:

Apple, Google, and other third-party platforms are not responsible for the Services,
your use of third-party platforms may also be subject to their separate terms, rules, and policies,
we are not responsible for third-party platform outages, removals, delays, approval decisions, billing issues, or policy changes,
and your carrier’s normal messaging, data, and other rates may apply.

Kajabi’s branded app infrastructure and app availability are dependent on Apple App Store and Google Play processes and related platform requirements.

13. In-App Purchases and Platform Billing

Use this section if you may enable in-app purchases. If not, you can keep it or remove it.

Some purchases or offers may be made available through our mobile apps. If a purchase is processed through Apple, Google, or another platform, that transaction may also be governed by that platform’s billing terms, purchase rules, and refund policies.

We are not responsible for third-party app-store billing practices, refund decisions, or platform-specific purchase restrictions.

14. Intellectual Property

All content, branding, trademarks, logos, graphics, videos, text, lessons, downloads, worksheets, technique sheets, site design, app design, and other materials made available through the Services are owned by or licensed to Elite You and are protected by applicable intellectual property laws.

We grant you a limited, revocable, non-transferable, non-exclusive license to access and use the Services for your personal, non-commercial use only.

You may not, without our prior written permission:

copy,
reproduce,
distribute,
republish,
sell,
sublicense,
scrape,
record,
share paid content outside your account,
or otherwise exploit our content for commercial or unauthorized purposes.

15. Acceptable Use

You agree not to:

violate any law or regulation,
use the Services for unlawful, violent, threatening, abusive, fraudulent, or deceptive purposes,
encourage illegal conduct,
infringe anyone’s rights,
harass or intimidate others,
impersonate another person,
interfere with site or app security or operation,
share account access improperly,
upload malicious code,
or use bots, scraping tools, or automated systems without authorization.

You also agree not to use the Services to seek or provide individualized illegal-use guidance, unlawful weapons advice, or other unlawful conduct.

16. Community and User Content

If the Services include comments, community areas, or other interactive features, you remain solely responsible for any content you post, upload, or submit (“User Content”).

By submitting User Content, you represent and warrant that:

you own it or have the right to submit it,
it does not violate any law or third-party rights,
and it is not abusive, unlawful, threatening, defamatory, obscene, or misleading.

You grant Elite You a non-exclusive, worldwide, royalty-free license to host, store, display, reproduce, modify for formatting, and use that User Content as reasonably necessary to operate, promote, and provide the Services.

We may remove, restrict, edit, or refuse any User Content at our discretion.

17. Privacy

Your use of the Services is also subject to our Privacy Policy, which explains how we collect, use, and protect personal information, including information submitted through the website, apps, forms, and related services.

By using the Services, you acknowledge that you have reviewed our Privacy Policy.

18. Disclaimers

THE SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ELITE YOU DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, OR THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

We do not guarantee:

any specific training result,
any increase in safety,
any business outcome,
any fitness outcome,
or that any content will be suitable for your particular needs.

19. Health and Physical Condition

If you engage in any physical training, drills, practice, or related activity discussed in the Services, you are solely responsible for ensuring that you are medically, physically, mentally, and legally able to do so.

You should consult qualified professionals when appropriate before beginning physical or defensive training.

20. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ELITE YOU AND ITS OFFICERS, OWNERS, EMPLOYEES, CONTRACTORS, AFFILIATES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF:

THE AMOUNT YOU PAID US IN THE SIX (6) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR
ONE HUNDRED U.S. DOLLARS ($100).

Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

21. Indemnification

You agree to defend, indemnify, and hold harmless Elite You and its officers, owners, employees, contractors, affiliates, and agents from and against any claims, liabilities, damages, judgments, losses, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to:

your use of the Services,
your violation of these Terms,
your violation of law,
your User Content,
or your infringement of any third-party rights.

22. Suspension and Termination

We may suspend, restrict, or terminate your access to the Services at any time, with or without notice, if:

you violate these Terms,
you misuse the Services,
you create risk for us or others,
required payments fail,
or we otherwise determine, in our discretion, that your continued access is inappropriate.

Termination does not eliminate obligations that arose before termination.

23. Changes to the Services

We may modify, suspend, discontinue, or update any aspect of the Services at any time, including content, features, pricing, availability, app functionality, or platform support, with or without notice.

24. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the Effective Date above. Your continued use of the Services after updated Terms are posted constitutes your acceptance of those changes.

25. Governing Law

These Terms are governed by the laws of the State of Florida, without regard to conflict of law principles.

26. Venue and Disputes

Any dispute arising out of or relating to these Terms or the Services shall be brought exclusively in the state or federal courts located in [Insert County, State], and each party consents to the personal jurisdiction and venue of those courts.

27. Severability

If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in full force and effect.

28. Entire Agreement

These Terms, together with any policies or additional terms expressly incorporated by reference, constitute the entire agreement between you and Elite You regarding the Services and supersede prior or contemporaneous understandings relating to the same subject matter.
